1. General Information

These Terms and Conditions govern the use of the Oxygen Resort website (accessible at peneson.ro/oxygenshop) and the purchase of tickets, experience packages, and other services offered by Oxygen Resort, headquartered in Pasul Pângărați, Gheorgheni, Harghita County.

By accessing the website and making a purchase, you confirm that you have read, understood, and fully accepted these Terms and Conditions.

2. Services Offered

Oxygen Resort offers for sale tickets and packages for:

• Tourist circuits – guided tours in the Hășmaș Mountains and Transylvania area
• Stays – accommodation and activity packages at the resort
• Events – participation in cultural and recreational events in the area
• Houses and Museums – visits to sites of cultural heritage
• Recreational activities – bobsled track, adventure park, ski slope, salt room (salina), and more

The descriptions, photos, and programs displayed on the site are for informational purposes and may be updated without prior notice, provided that such changes do not materially affect the service you have already paid for.

3. Delivery of Digital Products

1. Select the experience, date, and number of participants.
2. Fill in the requested personal details in the reservation form.
3. Make the payment using the available method on the site.
4. You will receive a booking confirmation at the email address provided.
5. The participation ticket/voucher will be sent to you electronically and must be presented at check-in.
6. The client must also check the Spam folder.
7. If you do not receive the documents, notify nature.experience21@gmail.com or 0372 903 789.
8. After dispatch by email, the responsibility for receipt lies solely with the client.

The booking becomes firm only after confirmation of full payment.

4. Payment Policy

All prices displayed on the website are stated in Romanian Lei (RON) and include VAT where applicable. Oxygen Resort reserves the right to modify prices at any time without affecting already confirmed and paid bookings.

Payment can be made by:

• Only online through the EuPlătesc platform (Visa, Mastercard).
• The invoice is sent automatically. SSL and PCI DSS security.

5. Return Policy

Personalized digital services cannot be returned (OUG 34/2014). The client waives the right of withdrawal by checking the checkbox. No refund is issued, only a correct re-send if the initial document was erroneous.

6. Responsibilities of Participants

By purchasing a ticket, the participant agrees to:

• Follow the instructions of the guides and Oxygen Resort staff throughout the activity.
• Arrive at the designated place and time, according to the reserved schedule.
• Not participate in activities if they have relevant medical contraindications (e.g., heart conditions, mobility problems, pregnancy – for physically risky activities).
• Be properly equipped for the chosen activity (suitable footwear for hiking, winter equipment for snow activities, etc.).
• Respect the internal regulations posted at the location.

7. Limitation of Liability

Oxygen Resort is not liable for:

• The uninterrupted functioning or accuracy of the Oxygen Resort website is not guaranteed. We are not responsible for client errors or internal decisions.
• Accidents resulting from participant negligence or failure to follow safety instructions.
• Loss or damage to participants personal property during activities.
• Inability to carry out activities due to force majeure causes (extreme weather, natural disasters, restrictions imposed by authorities, etc.).

In all cases, the maximum liability of Oxygen Resort to a client is limited to the value of the ticket/package purchased.

8. Force Majeure

Oxygen Resort cannot be held liable for non-fulfillment or improper fulfillment of services caused by unforeseen and unavoidable events, such as extreme weather phenomena, natural disasters, pandemics, strikes, actions by authorities or other force majeure causes. In such situations, we will make reasonable efforts to offer you a reschedule or a voucher of equivalent value.

9. Intellectual Property

All site content (texts, photos, logos, graphics) and software belong to NATURE EXPERIENCE SRL. Commercial use without written consent is prohibited.

10. Governing Law and Disputes

These Terms and Conditions are governed by Romanian law. Any dispute will be settled amicably in the first instance. If an amicable solution is not possible, the dispute will be submitted to the jurisdiction of Romanian courts.

Alternatively, you may use alternative dispute resolution (ADR) procedures via the European ODR platform or at ANPC.

11. Final Provisions

Accessing the website implies acceptance of the terms. Any changes will be published on the same site.

Requests may be submitted to Oxygen Resort directly by NATURE EXPERIENCE SRL.
